A Delhi court on Thursday issued a notice to the Tihar jail authorities seeking its response of a petition filed by the convicts in Nirbhaya gang-rape and murder case seeking a stay on the execution, which is scheduled for February 1.

Session Judge AK Jain asked Tihar Jail authorities to submit a status report before 10 am tomorrow. The hearing in the matter will be heard tomorrow.

"This is clearly a mockery of justice. Convicts' lawyers are taking too much time to use their legal remedies. Convict Vinay filed his mercy plea yesterday," public prosecutor Irfan Ahmad told the court. In his petition filed in the Patiala House Court, advocate AP Singh who is the lawyer of convicts Akshay Thakur and Vinay Sharma, said that according to the Delhi Prison Rules, none of those convicted can be hanged until all of them have exhausted all legal options. -- ANI

16:23   Reactions to dismissal of convict's curative petition
Two sides to the Nirbhaya convicts' hanging:

Convicts' lawyer: Asserting that anyone can make mistakes, advocate AP Singh, who is the lawyer of the Nirbhaya gang-rape and murder convicts, on Thursday said that Supreme Court judges and President of India are not gods.

The statement came after a five-judge bench of the apex court dismissed the curative petition of Nirbhaya convict Akshay Thakur in the matter and rejected an application seeking a stay on the convicts' execution, which is scheduled for February 1.

"Be it five senior judges of the Supreme Court or the President of India, they are not gods. It is not like they cannot make a mistake," Singh told reporters here. He said that the apex court did not agree with the grounds for the curative petition. Informing that he has also filed a petition in the Patiala House Court seeking a stay on the execution of the convicts, Singh said that he "will also file a review petition pertaining to the juvenility of Pawan Kumar Gupta," who is also a convict in the matter.

Nirbhaya's lawyer Seema Kushwaha said that the only legal remedy the convicts' are left with is the mercy petition."We have come very close to the date of the execution. Now, they will not get any relief from anyone. The only legal remedy they have now is the mercy petition, which I don't think they should be allowed. I hope that the convicts are hanged on February 1," Kushwaha told ANI.

Nirbhaya's parents:
The dismissal of the curative petition of Akshay Thakur by the Supreme Court has brought the convicts closer to their execution and now without any delay, they should be hanged on February 1, said Nirbhaya's mother Asha Devi on Thursday.

"They have moved a step forward towards their execution. Now, nothing is left to provide them as they were given all the time. All that is left is to hang them. Now, they should be hanged without any delay," Devi told ANI.

"It's not only me but everyone has understood that they are trying to delay the execution. They have made a mockery of the system. I still hope that they will be hanged on February 1 and will continue with the fight," she added.

Expressing happiness over the Supreme Court's decision, Nirbhaya's father Badrinath Singh said: "I welcome the decision of the top court. There is, of course, a delay in the process but we are not disappointed. We hope they will be hanged soon."

15:48   Identify shooter by his clothes: Owaisi to PM
MP and AIMIM President Asaduddin Owaisi takes a dig at PM Narendra Modi over the shooting at a Jamia University-led anti-CAA protest in Delhi which left one person injured. The shooter has been arrested by the Delhi police, which is being slammed for being silent bystanders even as the man, now identified as Ram Bhagat Gopal, was brandishing his gun.

Owaisi tweeted, "Thanks to @ianuragthakur & all the 9 PM nationalists who have created so much hatred in this country that a terrorist shoots a student while cops watch.
Hi @PMOIndia identify him by his clothes."

MoS Finance Anurag Thakur had exhorted people shoot anti-nationalists during a rally for the Delhi polls, last week.

Last month, the PM had said accused the Congress and its allies of fuelling violence over the amended Citizenship Act, and said the opposition's actions prove that the decision to pass the bill was "1,000 per cent correct", and those indulging in arson "can be identified by their clothes."

Owaisi targetted the Delhi police, tweeting, "What happened to the bravado that you showed in #Jamia last month? If there's a prize for being 'helpless' bystanders, you'd win it every time. Can you explain why a gunshot victim had to CLIMB over a barricade?
Do your service rules stop you from being HUMANE?
It happened today, when we were remembering terrorist Godse's murder of Gandhi. When students were going to march to mark the event.
Such cowardice does not scare us. The protests will go on. This is now Godse v. Gandhi's, Ambedkar's & Nehru's India. It's easy to pick a side."

13:24   Godse, Modi believe in same ideology: Rahul
Rahul Gandhi compared Mahatma Gandhi's assassin Nathuram Godse with Prime Minister Narendra Modi, saying both believed in the same ideology. Gandhi, at an anti-CAA rally in Wayanad, launched a scathing attack on Modi and said he was making Indians to prove that they are Indians.

Addressing participants at "Save the Constitution" march at Kalpetta in Wayanad, his Lok Sabha constituency on Martyr's Day, Gandhi said there was no difference between Godse and Modi.

"Today, an ignorant man is trying to challenge Gandhi's ideology. He is creating an atmosphere of hatred. The ideology is the same. Nathuram Godse and Narendra Modi, they believe in the same ideology. There is no difference except that Modi does not have the guts to say he believes in the ideology of Godse," the Wayanad MP said.

Attacking the Prime Minister on the new Citizenship Law, Gandhi questioned Modi and asked who was he to ask Indians to prove that they were Indians. "Indians are being made to prove that they are Indians. Who is Narendra Modi to decide who is an Indian. Who gave Modi the licence to ask for my Indianness? I know I am an Indian and I don't have to prove it to anyone. Likewise, 1.4 billion Indians do not have to prove that they are Indians," he said.

"Maharashtra Minister Jitendra Awhad has clarified that his statement was misconstrued. This means he has gone back on the statement he gave yesterday. This is right. He had yesterday accused late Indiraji of strangulating democracy. The ministers should live in the present rather than in the past to avoid political blunders," Nirupam's tweet, roughly translated in English from Hindi, reads.

"Indira Gandhi had also strangulated democracy, nobody was ready to speak against her. Then, students from Ahmedabad and Patna protested and JP's movement started leading to her defeat. 10:57   India's gold demand falls 9 pc on record prices in 2019: WGC
India's gold demand fell nine per cent to 690.4 tonnes in 2019 from the previous calendar year as record domestic prices and economic slowdown dented retail purchase, the World Gold Council (WGC) said on Thursday.

However, in 2020, gold demand in India -- the world's second biggest consumer after China -- could increase to 700-800 tonnes on hopes of increased acceptance of high price level and likely economic reforms boosting consumer confidence. The domestic gold price finished 2019 just above Rs 39,000 per ten grams, almost 24 per cent higher than at the end of 2018, WGC said in its latest report. -- PTI

10:14   BJP's star campaigns in Delhi begin on Feb 1
In a major shift of strategy ahead of the Delhi assembly polls, the Bharatiya Janata Party has decided to rope in its senior leaders for massive public rallies.

Its star campaigners like Prime Minister Narendra Modi, Union Home Minister Amit Shah, BJP chief JP Nadda, Uttar Pradesh Chief Minister Yogi Adityanath, and other union ministers would now be addressing massive public rallies in addition to ongoing neighbourhood meetings.

"The big rallies would begin from February 1. While 'Nukkad' meetings will take place till the last day of campaigning, there would be big rallies of the top leadership of the party, " informed a senior party leader.

Sources told ANI that the BJP has changed its strategy after the success of its grassroots contact program as the party wants to consolidate its gains.

"As part of the reworked strategy the BJP has asked its various Mandals to organise public meetings of 10,000-15,000 people in each assembly segment to reach out to the masses," sources added.

While there are two planned for Prime Minister Modi, two have been planned for JDU chief and Bihar Chief Minister Nitish Kumar along with Nadda and Amit Shah. Yogi Aadityanath too would be addressing 12 rallies.

The party is leaving no stone unturned to secure massive gains, which it feels can be converted to victory in the forthcoming polls.

Party sources feel that the relentless campaigning under the guidance of Amit Shah and Nadda has ensured that the morale of party cadre is at an all-time high.

"The neighborhood meetings have ensured that we have been able to make the people of Delhi aware of the lack of work under the Arvind Kejriwal led Aam Aadmi Party government. They have also been apprised about the anti-national views of the opponents and we think that this is expected to turn the polls into our favor," sources added.

Delhi is scheduled for assembly polls on February 8 and the results for the 70 constituencies will be declared on February 11.

As part of the new strategy, senior leaders like JP Nadda, Amit Shah, Uttar Pradesh chief minister Yogi Adityanath, ministers like Rajnath Singh and Smriti Irani would be holding public rallies in various parts of the city. Several other chief ministers from various BJP ruled states are also expected to be roped in for the campaign.

The strategy for reach out to the masses is an attempt at weakening the hold of AAP on Delhi. With positive feedback coming after the success of the neighborhood meetings in the past week, the BJP is now looking to increase its potential reach with polls just days away. Till now the party had deployed 70 union ministers to hold at least one public meeting and one 'padayatra' each as part of the campaign. -- ANI

"There aren't enough words to describe our pain right now," said Vanessa Bryant on Thursday, breaking her silence days after the sudden demise of her husband Kobe Bryant and their 13-year-old daughter Gianna Maria Onore Bryant in a helicopter crash incident.

Vanessa posted a family photo on Instagram along with a statement."My girls and I want to thank the millions of people who've shown support and love during this horrific time. Thank you for all the prayers. We definitely need them. We are completely devastated by the sudden loss of my adoring husband, Kobe -- the amazing father of our children; and my beautiful, sweet Gianna -- a loving, thoughtful, and wonderful daughter, and amazing sister to Natalia, Bianka, and Capri," Vanessa said.

"We are also devastated for the families who lost their loved ones on Sunday, and we share in their grief intimately. There aren't enough words to describe our pain right now. I take comfort in knowing that Kobe and Gigi both knew that they were so deeply loved. We were so incredibly blessed to have them in our lives. I wish they were here with us forever. They were our beautiful blessings taken from us too soon," she added.

"I'm not sure what our lives hold beyond today, and it's impossible to imagine life without them. But we wake up each day, trying to keep pushing because Kobe, and our baby girl, Gigi, are shining on us to light the way. Our love for them is endless -- and that's to say, immeasurable. I just wish I could hug them, kiss them and bless them. Have them here with us, forever," Vanessa further said in her statement.

"Thank you for sharing your joy, your grief and your support with us. We ask that you grant us the respect and privacy we will need to navigate this new reality," she added. 09:35   Indira strangulated democracy, students defeated her: NCP minister
Maharashtra minister and NCP leader Jitendra Awhad has said that history will repeat itself just like former Prime Minister Indira Gandhi's attempt to strangulate democracy in the past was defeated by students similarly, students will do so in the present day too.

"Indira Gandhi had also strangulated democracy, nobody was ready to speak against her. Then, students from Ahmedabad and Patna protested and JP movement started leading to her defeat. This history will be repeated in Maharashtra and the country," Awhad said in a public meeting in Beed on Wednesday.

Awhad said this in an apparent reference to the amended Citizenship Act brought by the Centre, which is being opposed by various state governments and protests, by citizens, are also being held across the country against it.

Jayaprakash Narayan, also called Lok Nayak, had launched a mass movement against Indira Gandhi's government in 1974. Jailed during the Emergency he defeated the Congress party in 1977 for the first time which led to the formation of the Janata Party government in the Centre.

However, not new to giving controversial statements, Awhad had recently on January 20 said that ancestors of people sitting on the throne in Delhi "were appeasing" the British at the time when Awhad's father was facing a death sentence for the sake of the country.

He further added that Muslims can point out where their grandfathers were buried but Hindus may not be able to say where the last rites of their ancestors were conducted.

"I would ask the (people at) throne in Delhi, will you ask proof of me being an Indian? Then listen to this -- when your father was licking the boots of the British after bowing to them, my father was embracing death and raising slogans Inquilab Zindabad," he said at a rally against the CAA in Maharashtra.

"I want to ask, my Hindu brothers are sitting here, where were you when your grandfather's last rites were performed? Muslims can tell where their graveyards are," he added. The CAA grants citizenship to non-Muslim refugees from Pakistan, Afghanistan, and Bangladesh, who came to India on or before December 31, 2014. -- ANI

08:31   SC to hear 3rd Nirbhaya convict's plea today
The Supreme Court will today hear the curative petition of one of the four Nirbhaya gang-rape death row convicts, Akshay Thakur who is seeking commutation of his death sentence to life imprisonment.

A five-judge bench of the apex court, headed by Justice NV Ramana will hear the petition in the 2012 Delhi gang-rape case at 1 pm. The curative petition, filed by advocate AP Singh on behalf of Akshay, states that the present curative petition should be allowed by the apex court and it should set aside the May 5, 2017 order, which upheld the death sentence of the convicts.

"Modify the sentence of the petitioner, to life imprisonment as it serves all the purposes that the death penalty claims to serve and protects society from the impending reality in the near-future in which torture and murder are equated with justice as a panacea for all social evils," the petition said.

The plea said that lack of criminal antecedents, erroneous reliance on deterrence, and the probability of reformation, socio-economic circumstances, non-consideration of constitution bench judgment, were not considered by the courts while awarding his client to death.

The top court had dismissed Akshay's review petition in December last year.

A three-judge bench of the apex court yesterday dismissed the plea of another Nirbhaya Mukesh Kumar Singh challenging the rejection of his mercy petition by the President.

08:03   EU parliament's vote on CAA delayed till March
A joint motion, combining five different resolutions tabled by Members of the European Parliament against India's Citizenship Amendment Act, was debated at the Plenary session in Brussels, with an expected vote on the motion on Thursday postponed until March.

The debate opened with a statement by Helena Dalli, the vice-president of the European Commission and High Representative of the Union for Foreign Affairs and Security Policy, who spoke strongly in favour of the "rich, frank and open" relationship the European Union shares with India.

She highlighted Prime Minister Narendra Modi's upcoming visit to Brussels in March for the 15th India-EU Summit.
"We believe that it is the role of the Supreme Court of India to assess the compliance of the law with the Constitution and we are confident that the ongoing judicial process will contribute to appeasing the tensions and violence witnessed over the past weeks in the country," said Dalli, who concluded the debate with a message to "pursue and intensify" dialogue with India as a "respected democracy" and valued EU partner.
