23:31   Real tukde-tukde gang sitting in Delhi: Guha
The real tukde-tukde gang are the rulers of India sitting in Delhi, said historian Ramachandra Guha.

Speaking to India Today TV, Ramachandra Guha said that the people sitting in Delhi are the "real batwara" people.

"The real tukde-tukde gang are the rulers of India sitting in Delhi. They are real batwara people. They are dividing the country not just on religion but also on language and we will resist them non-violently," Ramachandra Guha said.

Ramachandra Guha was on Thursday detained on Thursday for staging a demonstration against the Citizenship Amendment Act and NRC at the Town Hall in Bengaluru in defiance of the prohibitory orders imposed in Bengaluru.

On being asked about his detention, Ramachandra Guha said he was not violating Section 144 which was in place in Bengaluru.

"I was not violating section 144. There was absolutely no reason to impose Section 144. It was a completely knee-jerk and exaggerated reaction that I suspect came from Delhi. Delhi ordering Bengaluru what to do," Ramachandra Guha said.

He further said Section 144 was a colonial-era law and was used to suppress the non-violent struggle of our freedom movement.

20:05   Common documents, no pre-1971 papers for NRC
Seeking to allay citizenship concerns of a large number of people, government sources said on Thursday that one can prove Indian nationality by submitting any document related to his date of birth and its place, and there will be "absolutely no compulsion" to submit any document by his parents during any such exercise.

An explainer shared by official sources said no document will be required for anybody's pre-1971 genealogy as such a condition was specific to the NRC exercise in Assam and asserted that it will be sufficient to provide one's details of birth like date and place in any future nationwide NRC.
The clarification comes in the wake of allegations from opposition parties and civic groups that the amended citizenship law and the proposed National Register of Citizens are divisive and discriminatory against Muslims.

Protests have been going on in various parts of the country against the law.
Sources said the NRC, as and when it is implemented, has nothing to do with any religion and will be for every citizen of India as it is a citizen register in which names of every Indian will be recorded.
The Citizenship (Amendment) Act is a separate law and the NRC is a separate process, they said, adding that the CAA has come into force nationwide after its passage from Parliament, while the NRC rules and procedures for the country are yet to be decided.
The explainer said if somebody is "illiterate" and has no documents, witness and community verification will be allowed during any such exercise to ensure that no Indian citizen is troubled.
Citizenship can be proved by submitting any documents related to date of birth and place of birth, it said, adding that a decision is yet to be taken on such acceptable documents.

"This is likely to include voter cards, passports, Aadhaar, licenses, insurance papers, birth certificates, school leaving certificates, documents relating to land or home or other similar documents issued by government officials. The list is likely to include more documents so that no Indian citizen has to suffer unnecessarily," it said.

The explainer said the NRC is merely a normal process to register one's name in the citizens' register.
Just like people present their identity cards or any other document for registering  names in the voter list or getting Aadhaar card made, similar documents need to be provided for the NRC as and when it is carried out, it said.

Noting that a person's citizenship is decided on the basis of the Citizenship Rules, 2009, it said there are five ways for somebody to become a citizen, which are citizenship by birth, registration, naturalization, and incorporation.

Responding to a question that if it is so easy to prove identity, then how 19 lakh people in Assam were affected due to the NRC, the explainer said infiltration is an old problem in the state and the Rajiv Gandhi government in 1985 had signed an agreement to curb it, putting the cut-off date of 25 March 1971.
"For the rest of the country, the NRC process is completely different and under The Citizenship (Registration of Citizens and Issue of National Identity Cards) Rules, 2003," it said.

19:54   UP CM warns of strong action against vandals, says will auction their property
Uttar Pradesh Chief Minister Yogi Adityanath said on Thursday his government will take "revenge" on those involved in the violence over the amended Citizenship Act by auctioning their property to compensate for the losses.

"There is no place for violence in a democracy. In the name of opposing the CAA, the Congress, SP and Left parties have pushed the entire country to fire.

"There was violence in Lucknow and Sambhal and we will deal with it strictly. All properties of those involved in damaging public assets will be seized and auctioned to compensate for the losses," he said.

"They have been captured in video and CCTV footage. We will take 'badla' (revenge) on them," Adityanath said.

He added that prohibitory orders under section 144 of the CrPC has been in force in the state since November 8 and no demonstration can take place without permission.

"Violence in the name of demonstration is not acceptable. I have talked to the officers and will ensure that the common man does not have any problem. We will strictly deal with those involved in violence," the chief minister said.

He alleged that opposition is creating confusion on CAA as it was sidelined and ignored by the people.

"The CAA its is not against any religion or section of society. It will ensure safety and help refugees from the other countries," Adityanath contended.

19:14   Preventing protest insult to India's soul: Rahul
Hitting out at the government for trying to prevent peaceful protests against the Citizenship Amendment Act, Congress leader Rahul Gandhi on Thursday said doing that is an insult to Indias soul.

This government has no right to shut down colleges, telephones & the Internet, to halt metro trains and to impose #Section144 to suppress Indias voice & prevent peaceful protests. To do so is an insult to Indias soul, tweeted Gandhi who is currently out of India.

Earlier in the day, Rahuls sister and Congress general secretary Priyanka Gandhi Vadra warned that the more the government tries to suppress the voice of people, the louder it will become. She said the government has shut metro stations and internet services in Delhi and have imposed CrPC Section 144, which prohibits an assembly of four or more people.

Senior opposition leaders, a large number of students and activists were detained on Thursday by police on their way to two mega demonstrations against the new citizenship law as prohibitory orders and restrictions on internet and mobile phone services in parts of Delhi-NCR region inconvenienced thousands of people.

18:35   MHA to hold review meet over anti-CAA protests
The Ministry of Home Affairs will hold a review meeting on Thursday over the protests against the Citizenship (Amendment) Act, 2019 in different parts of the country.

Protests erupted across the country over the amended Citizenship Act, which seeks to grant citizenship to Hindus, Sikhs, Jains, Parsis, Buddhists and Christians fleeing religious persecution from Pakistan, Afghanistan and Bangladesh and came to India on or before December 31, 2014. At some places, the protest turned violent and public property was vandalised during the agitation.

On Wednesday, MHA spokesperson had clarified that the Act does not apply to Indian citizens and they are completely unaffected by it.

"Citizenship of India can be acquired by birth, descent, registration, naturalisation or incorporation of territory. Any foreigner on becoming eligible can acquire citizenship by registration or by naturalisation irrespective of his country or community. #CAA2019 enables foreigners of six minority communities from three countries to apply for citizenship on the basis of religious persecution," the spokesperson stated.

18:24   India did not discuss CAA with US: MEA
The Ministry of Home Affairs will hold a review meeting today over the protests against the Citizenship (Amendment) Act, 2019 in different parts of the country.

At the press briefing today when asked if the CAA issue was raised by US Secretary of State, Mike Pompeo, during 2+2 Ministerial meeting, in Washington DC, Raveesh Kumar said, "This issue, being an internal matter of India, was not discussed in the 2+2 meeting.  I'm not aware of the specifics of what was discussed in EAM's meeting with the Senate Committee on Foreign Relations. But our perspective on the Act has been shared with the US interlocutors, including the US Congress. We've highlighted the points which we have articulated in Parliament and subsequently which has been repeatedly said by the PM and Home Minister. I can only say that in the context of his meeting with the members of the US Congress, EAM shared our perspectives on this issue."

On the Bangladesh FM and HM cancelling their visit to India, the MEA spokesperson said, "There have been comments about some of the meeting etc being postponed/cancelled with Bangladesh. We have to understand that, with Bangladesh, there are over 75 dialogue mechanisms which are taking place. Dates are decided through mutual consultation.

"Our understanding is, a relationship which is as close as between our two countries should not be defined in terms of the postponement of a visit here and there. Bangladesh has explained the reasons why the visit has been postponed."

18:07   Mamata calls for UN-led referendum on CAA
West Bengal Chief Minister Mamata Banerjee on Thursday demanded a referendum by an "impartial organisation" like the United Nations to see how many people were in the favour of the Citizenship (Amendment) Act.

"Let there be an impartial organisation like United Nations or National Human Rights Commission hold a referendum to see how many people are in favour or against Citizenship (Amendment) Act", she said while addressing a gathering.

She also accused the BJP of "dividing" the country and said that the protests against the amended Citizenship Act will not stop unless the government withdraws the legislation, which aims to grant citizenship to non-Muslim refugees from three countries in India's neighbourhood.

"Suddenly after 73 years of independence, we have to prove that we are Indian citizens. Where was BJP's at that time, BJP is dividing the country. Don't stop your protest because we have to get CAA revoked... Protests will get stronger as the day passes," Banerjee said while speaking at a protest in Kolkata.

She also termed it 'dirty politics' and said, "You have won 38 per cent vote after doing so much and many of them are against you. It's bad luck for us that we have to give our fathers and mothers identity. All are citizens and suddenly who gave this idea that we have to give proof of it... They are doing dirty politics".

Banerjee has been vehemently opposing the amended Citizenship Act and has even said that she will not allow the legislation to be implemented in West Bengal.

Several other non-BJP chief ministers have also echoed similar sentiments.Protests erupted across the country over the Citizenship (Amendment) Act, 2019, which seeks to grant citizenship to Hindus, Sikhs, Jains, Parsis, Buddhists and Christians fleeing religious persecution from Pakistan, Afghanistan and Bangladesh and came to India on or before December 31, 2014.

17:49   Centre, Del police on notice over Jamia violence
The Delhi High Court on Thursday issued a notice to the Central government and the city police on the various petitions related to the Jamia Milia Islamia incident.

A Division Bench of Chief Justice D N Patel and C Har Shankar asked the Centre and Delhi Police to file a response to the petitions and listed the matter for further hearing on February 4.

Various petitioners have moved the High Court seeking remedies including forming of a fact-finding committee to probe the violence that took place after the Delhi Police and students protesting against the Citizenship (Amendment) Act, clashed.

The petitioners said that this was the "most significant attack" on the students since independence and appealed to Solicitor General Tushar Mehta to work as Amicus Curiae.

Meanwhile, the petitioner's counsel also sought interim relief from any coercive steps against them.

As the court denied granting any interim protection and giving a shorter date for hearing, some of the lawyers present in the courtroom shouted "shame, shame".

The judges, however, did not react, ignored the hooting and left for their chambers.

One of the petitioners told the court that around 450 tear gases were fired during the Jamia Milia incident which is highest since 2012.

Appearing for the petitioners, senior advocates Sanjay Hegde and Indira Jaising referred to various medical reports confirming grievous injuries and said that one of the students had suffered bullet injuries. They also raised questions over police entering the university campus without permission and attacking unarmed students.

Senior Advocate Colin Gonsalves requested the court to grant medical assistance for injured students, to keep criminal proceedings against students in abeyance, to preserve the CCTV footage to find out who is right and who is wrong.

17:11   Nirbhaya: HC dismisses convict's juvenile plea
The Delhi High Court on Thursday dismissed a petition filed by one of the death-row convicts in the Nirbhaya rape case, who had claimed that he was minor at the time of the offence and should be treated under the Juvenile Justice Act.

Justice Suresh Kumar, while dismissing his plea, also imposed a fine of Rs 25,000 on convict Pawan Kumar Gupta's lawyer A P Singh for not appearing before the court for hearing and wasting its time by trying to play "hide and seek" game.

The court has also asked the Delhi Bar Council to take action against the advocate.

The court had earlier adjourned till January 24 the matter but after Nirbhaya's parents objected, it recalled it and listed the matter for later today.

Gupta, in his plea, had stated that since he was juvenile in 2012 when the rape was committed, he should be treated under the Juvenile Justice Act. He alleged that his ossification test was not done at that point of time and he should be given the benefit of that.

The convict argued that the claim of juvenility can be raised at any time even after the final disposal of the case.

"Ossification test of the petitioner was conducted by the investigating officers. The age verification report filed by the investigating officers could not be relied upon. The convict should be treated as a juvenile under the Juvenile Justice Act," stated the petition. -- ANI

12:52   Nirbhaya convict's 'juvenile' claim listed today
The other big update -- the death sentence of the Nirbhaya convicts.

After Nirbhaya's parents objected to the adjournment order given by the Delhi High Court on a petition filed by one of the death-row convicts in the Nirbhaya rape case claiming that he was a juvenile at the time of the offence, the court recalled it and listed the matter for today itself.

Justice Suresh Kumar Kait had earlier today adjourned the matter for January 24 following which the counsels representing victim's parents again mentioned the matter and objected to the adjournment.

The court had adjourned the matter after convict Pawan Kumar Gupta's lawyer, advocate A P Singh, sought time to file fresh documents.

Gupta, in his plea, had stated that since he was juvenile in 2012 when the rape was committed, he should be treated under the Juvenile Justice Act. He alleged that his ossification test was not done at that point and he should be given the benefit of that.

The convict argued that the claim of being juvenile can be raised at any time even after the final disposal of the case. "Ossification test of the petitioner was conducted by the investigating officers. The age verification report filed by the investigating officers could not be relied upon. The convict should be treated as a juvenile under the Juvenile Justice Act," stated the petition.

09:36   Trump reacts to impeachment
US President Donald Trump tweets his reaction to his impeachment by the US House of Representatives last night.

The House impeached Trump on two counts -- abuse of power and obstructing the Congress. The first article of impeachment, abuse of power, was on party lines with 230 to 197 votes. The second article of impeachment, obstruction to the Congress, was voted 229-198 votes.

The White House described the impeachment as one of the most shameful political episodes in the history of the US. All four Democratic Indian American members of the House of Representatives voted to impeach Trump. The impeachment now moves to the Senate where Supreme Court Chief Justice would preside over the trial. Given that the ruling Republicans have majority in the 100-member Senate, political analysts say that impeachment is likely to fail and the Democrats might not be able to unseat Trump from the Oval Office. Senate Majority Leader Mitch McConnell said he would hold an impeachment trial early next year.

08:53   CAA doesn't apply to any Indian citizen: MHA
Amid protests against the Citizenship (Amendment) Act, 2019, in various parts of the country, the Ministry of Home Affairs (MHA) spokesperson has clarified that the Act does not apply to Indian citizens and they are completely unaffected by it.

Taking to Twitter on Wednesday, MHA spokesperson explained the provisions pertaining to citizenship in India and some concerns regarding the Act.

'Citizenship of India can be acquired by birth, descent, registration, naturalisation or incorporation of territory. Any foreigner on becoming eligible can acquire citizenship by registration or by naturalisation irrespective of his country or community. #CAA2019 enables foreigners of six minority communities from three countries to apply for citizenship on the basis of religious persecution,' the spokesperson stated.

'It does not amend any existing legal provision which enables any foreigner to apply for Indian citizenship through registration/naturalisation. The CAA does not apply to Indian citizens. They are completely unaffected by it,' it further noted.

The spokesperson further informed that in the last six years, 2830 Pakistani, 912 Afghani and 172 Bangladeshi citizens have been given Indian citizenship.

'Many of them are from the majority community of these countries. Such migrants of the majority community of neighbouring countries shall continue to get Indian citizenship if they fulfil the eligibility conditions already provided in the law for registration or naturalisation,' the ministry official stated.

'On different occasions, special provisions have been made by Government in the past to accommodate the citizenship of foreigners who had to flee to India. E.g. 4.61 lakh Tamils of Indian origin were given Indian citizenship during 1964-2008. The CAA does not target any religious community from abroad. It only provides a mechanism for some migrants who may otherwise have been called 'illegal' depriving them of opportunity to apply for Indian citizenship provided they meet certain conditions,' spokesperson added.  -- ANI

08:20   Trump impeached in US House for abuse of power
United States House of Representatives on Wednesday (local time) voted to impeach Donald Trump, making him the third President in American history to be impeached.

CNN reported that a majority of the US House of Representatives voted to support the two articles of impeachment against President Trump.

Trump faced two articles of impeachment -- abuse of power and obstruction of Congress.

According to CNN, on the first article of impeachment -- abuse of power -- 230 voted in favour and 197 voted against it.

The House of Representatives passed two articles of impeachment against President Trump.

The House voted primarily along party lines to impeach Trump on abuse of power and obstruction of Congress, reported CNN.

It has been nearly three months since House Speaker Nancy Pelosi announced that Democrats would launch an impeachment inquiry after an anonymous whistleblower complaint alleged that Trump had solicited interference in a July phone call with Ukrainian President Volodymyr Zelensky to help his 2020 reelection campaign.

Democrats said their investigation revealed a months-long campaign directed by the President and carried out by his personal attorney Rudy Giuliani for Ukraine to announce an investigation into former Vice President Joe Biden and his son Hunter Biden, along with the 2016 election.

The President withheld US security aid and a one-on-one meeting that Zelensky sought, they say, and then obstructed the investigation by defying congressional subpoenas across the administration.

"Very sadly, the facts have made clear that the President abused his power for his own personal, political benefit and that he obstructed Congress as he demanded that he is above accountability, above the Constitution and above the American people," Pelosi said in a letter to colleagues Tuesday.

"During this very prayerful moment in our nation's history, we must honour our oath to support and defend our Constitution from all enemies, foreign and domestic," the letter read.

Trump and his GOP congressional allies, however, had slammed the impeachment proceedings, accusing the Democrats of rushing to impeach him ahead of the 2020 election.

The President sent a blistering letter to Pelosi on Tuesday accusing Democrats of an 'illegal, partisan attempted coup'.

'History will judge you harshly as you proceed with this impeachment charade,' he wrote.

The House vote will eventually shift the impeachment proceedings to the Senate, where Republicans control the majority.

Senate Majority Leader Mitch McConnell on Tuesday predicted that the Senate would have a 'largely partisan outcome', after saying last week that he was coordinating with the President's lawyers ahead of the trial. -- ANI

00:12   Twitter slams Alia for sharing wrong Preamble
Alia Bhatt on Tuesday took to social media and shared a picture of the Preamble to the Constitution of India, as a mark of solidarity towards the students protesting against the Citizenship Amendment Act. However, she posted the wrong one.

"Learn from the students", she wrote with the picture of the preamble. Soon, netizens took to social media to point out her mistake and stated that she has shared the old one, where the description of India on the 42nd Amendment read a "sovereign democratic republic" and "unity of the nation". It was changed by former PM Indira Gandhi during the Emergency period to "sovereign, socialist secular democratic republic" and "unity and integrity of the nation".

Taking a jibe at the actress, one of the users wrote, "Alia Bhatt googles "Preamble", and uses the first picture that she could find. She doesn't even know that this is the original Preamble, which doesn't have the words "Secular" and "Socialist", the ideals that they claim to be protecting."

Another wrote, "Alia Bhatts support to the moment is like a proxy for an important lecture. You get the attendance in theory but practically you didnt learn/contribute. (sic)."

The list of Bollywood celebrities who have come forward to show support to students voicing protest against CAA has been steadily increasing. In the past couple of days, Vicky Kaushal, Bhumi Pednekar, Parineeti Chopra, Richa Chadha, Huma Qureshi, Nimrat Kaur, Dia Mirza, Swara Bhaskar, Manoj Bajpayee, Saurabh Shukla, and Anurag Kashyap, Alankrita Srivastava, Hansal Mehta have been among the many celebrities who have extended support to students.
