Take me as I am, end prejudice: CJI on 377

In a historic decision, the Supreme Court of India today decriminalised gay sex between consenting adults by reading down Section 377 of the Indian Penal Code (IPC).


The judgment titled Navtej Singh Johar & Ors. v. Union of India was delivered by a Bench of Chief Justice of India Dipak Misra and Justices Rohinton Nariman, AM Khanwilkar, DY Chandrachud and Indu Malhotra. CJI Misra and Justices Nariman, Chandrachud and Malhotra delivered separate, concurring judgments.


CJI Dipak Misra said there was a need to end prejudice and sexual orientation was natural. "Take me as I am. No one can take away from my individuality," Justice Misra said.


The court said, "Privacy is a fundamental right under the Puttaswamy case (Right to Privacy ruling)." The court also recognised that the logic that since LGBTQ community only forms a 'minuscule' part of the population is incorrect.

"Rights of the last man should also be preserved by the courts. Progressive interpretation of constitution and progressive realization of rights. The previous judgment was incorrect."
