SC reserves verdict on Section 377

The Supreme Court today reserved verdict on pleas challenging constitutional validity of section 377 of IPC which criminalises consensual gay sex.

The SC asked all the counsel who argued for and against it to submit written submissions by this Friday.

A Constitution bench comprising Chief Justice of India Dipak Misra and Justices R F Nariman, A M Khanwilkar, D Y Chandrachud and Indu Malhotra, decided to reserve its verdict last Thursday as well, and agreed to hear the interveners for 90 minutes today.

Earlier in the day, the SC asserted that the courts cannot wait for a "majoritarian government" to decide on enacting, amending or striking down a law if it violates fundamental rights.

"We would not wait for the majoritarian government to enact, amend or not to enact any law to deal with violations of fundamental rights," a five-judge bench headed by Chief Justice Dipak Misra observed while hearing a batch of petitions seeking decriminalisation of consensual gay sex.
