Welcome the historic judgment, says petitioner Shayara Bano

In a landmark verdict, the Supreme Court by a majority of 3:2 today ruled that the practice of divorce through triple talaq among Muslims is "void", "illegal" and "unconstitutional". The apex court held that the triple talaq is against the basic tenets of Quran.

First reactions from triple talaq victim Shayara Bano (pictured), one of the petitioners in the case said it was a historic day for Muslim women.

"Muslim samaj mein auraton ki stithi ko samjha jaye, is judgement ko accept kiya jaaye aur jaldi se jaldi kanoon bane. Judgement ka swagat aur samarthan karti hoon. Muslim mahilon ke liye bahut etihaasik din hai," she told ANI.

Bano had approached the Supreme Court for justice after her husband divorced her over an instant triple talaq. Her petition demanded a ban on the practices of nikah halala and polygamy as well, which the court has set aside for now. 

Shaista Amber, president of the All India Muslim Womens Personal Law Board, has also spoken out unequivocally against triple talaq, "We wanted this. We want the Parliament to uphold this. We have been waiting for this judgment."

While Chief Justice J S Khehar and Justice S Abdul Nazeer were in favour of putting on hold for six months the practice of triple talaq, asking the government to come out with a law in this regard, Justices Kurian Joseph, R F Nariman and U U Lalit held it as violative of the Constitution.

The majority verdict said any practice including triple talaq which is against the tenets of Quran in unacceptable. The three judges also said the practice of divorce through triple talaq is manifestly arbitrary and violative of the Constitution and must be struck down.
