SC asks Centre 7 questions on President's Rule in Uttarakhand

The Supreme Court today had seven tough questions as it asked the Centre to explain its decision to place Uttarakhand under President's Rule. Among the questions were:
1  Could the Governor have sent the message in the present manner under Article 175 (2) for conducting floor test, asks SC in one of its questions.

2.  Is disqualification of MLAs by the Speaker a relevant issue for the purposes of invoking President's rule under Article 356, asks SC.

3. Can proceedings in the Assembly be considered by the President for imposing Central rule? 

4. When does the President's role come into the picture with regard to the Appropriation bill?

5. Can a delay in the floor test be a ground for proclamation of President rule?

The Centre introduced President's Rule on March 27, a day before Harish Rawat was to take a trust vote. The government had argued that Rawat had lost the right to rule because when he presented the state's budget in March, nine Congressmen voted against it and the bill was defeated, though it was wrongly declared passed.


Rawat and the Congress say the Centre misused President's Rule to get rid of an elected government led by an opposition party.
