The parents of Arushi Talwar on Friday questioned Central Bureau of Investigation's very right to oppose their plea before the Allahabad high court to be discharged in the three-year old sensational murder case of their daughter.

After hearing the arguments led by senior advocate Gopal Chaturvedi, the bench comprising Justice B K Narayana fixed February 28 for continuation of the case.

Chaturvedi told rediff.com over teleohone from Allahabad, "We have questioned CBI's right to oppose our plea on the ground that the investigation agency must first decide whether it supports its own closure report or the order of the special Ghaziabad court, whereby Rajesh and Nupur Talwar were charged of their own daughter's murder."

He said, "We have also sought to draw the attention of the court to the half-baked investigation carried out by CBI , which was why further investigation was required in the case."

Fourteen-year old Arushi Talwar was murdered brutally in her Noida flat in May, 2008, while her servant Hemraj was also simultaneously bludgeoned to death in another part of the house.

After months of investigation and public debate, CBI named Aarushi's father Dr Rajesh Talwar, a well known dentist in Noida, as the main accused.

However, the CBI submitted its closure report earlier this month, without arriving at any concrete conclusion. Yet it sought to frame charges against the parents.
