Advocate Ajay Agrawal, who has been pursuing Bofors case in the Supreme Court, alleged in the application that despite the evidence against Quattrocchi, CBI declared its intention to withdraw the case against him.
Solicitor General Gopal Subramanium on Tuesday had told the apex court that the government has decided to drop the case against Quattrocchi, a sole accused left in the case as the Delhi High Court on May 31, 2005 quashed charges against all other accused.
He had said that the case against the 69-year-old Italian businessman could not be kept pending forever as two attempts by the government to extradite him has failed. The case against Quattrocchi is scheduled for hearing before the Chief Metropolitan Magistrate in New Delhi on October 3.
Agrawal in his application referred to the 1984 anti Sikh riots case in which a court turned down CBI's plea of closing a case against Congress leader Jagdish Tytler and directed the investigating agency to conduct fresh inquiry.
He had filed the appeal against the May 31, 2005 decision of the Delhi High Court quashing charges in the case after CBI had failed to challenge it in the mandatory 90-days period. His appeal has been admitted by the Supreme Court.
