Notice to Mumbai Police on alleged fake encounter

The Patna High Court on Friday issued notices to the Maharashtra government and the Mumbai police in connection with the alleged fake encounter of a youth from Bihar in the metropolis.

Rahul Raj, was killed in a shootout with the police at suburban Kurla after he fired indiscriminately and threatened passengers in the bus. Rahul reportedly claimed that he had come to the city to kill Maharashtra Navnirman Sena leader Raj Thackeray.

Responding to a petition, seeking probe by the Central Bureau of Investigation into the case, the division bench headed by Justice Ajay Kumar Tripathi also directed the agency and the Centre to file their affidavit within six weeks.

Rahul's father Kundan Prasad Sinha, in his petition, referred to the post-mortem report and alleged that his son was shot dead by the police from point-blank range in a fake encounter. He also contended that the Maharashtra government had failed to provide the forensic report and other documents related to his son's killing despite repeated requests to the chief minister and the Mumbai police commissioner.

The hearing in the case is likely to resume after six weeks.
