The Delhi High Court recently, in a landmark judgment, termed consensual sex between adults of the same sex legal.
The court held that the law making it a criminal offence violated fundamental rights. However, the bench comprising Chief Justice A P Shah and Justice S Murlidhar said Section 377 of the Indian Penal Code, which criminalised homosexuality, will continue for non-consensual and non-vaginal sex.
