Court dismisses petition
against Musharraf

The Lahore high court has dismissed a petition challenging the legality of the Legal Framework Order, which incorporates Gen Pervez Musharraf's election as the nation's president through a referendum as well as his controversial constitutional amendments, on the grounds that the issue should be addressed by the supreme court.

The president was vested with the power to amend the Constitution by the apex court and as such it was for the same court to see whether he has transgressed the authority conferred upon him by promulgating the LFO, Justice Mohammed Saeed Akhtar observed on Thursday while disposing a writ petition by the Pakistan Lawyers Forum challenging the validity of the LFO.

The judge observed that the transfer of power from the armed forces to civil society had always been difficult but not impossible.

"The country cannot be plunged into chaos, confusion and instability at this juncture and the question may be left to be determined by the proper forum," he said.

A petition in this regard is pending before the supreme court.
