Yasin Malik permitted to go abroad for treatment

Special Judge V K Jain ruled that Malik's passport be returned to him to enable him to get a visa from the United States embassy.

The court, however, made it clear that if the passport granted to the accused was revoked at any point of time before he leaves India, then he would not be entitled to leave the country on the strength of this order.

"This permission is subject to further condition that the counsel for the accused shall remain present on every date of hearing and the accused shall not dispute his identity and no adjournment shall be sought by him," the order said.

The court also directed Malik to file an affidavit stating therein the full address of the hospital where he would be operated and place of his stay in the US.

Stating that the JKLF leader would not leave those places during his stay in US, the court directed him to file an undertaking to the effect that he would return to India latest by October 31.

The court said Malik, against whom TADA cases were pending in Jammu, has to obtain a no-objection certificate from there and has to file a copy of it before leaving India.

The order allowing Malik to go abroad followed CBI's filing its reply on the JKLF leader's application seeking permission to visit the US for treatment.

The agency, in its reply, had stated that it has no objection to Malik's request provided the accused gives the details of his stay in US.

In a related matter, the court dismissed Malik's application seeking modification of his bail condition that he be permitted to mark his presence at a police station in Srinagar.

JKLF leader's plea was rejected after the CBI informed the court that the agency does not have any office in Srinagar.

Malik declined to mark his presence at a police station in Jammu.

While granting bail to Malik, the court had directed him to mark his appearance before the Tilak Marg police station on the 16th of every month.
