The West Bengal police on Monday said that it has arrested 354 miscreants across the state to maintain peace and harmony.

It also urged the public to contact the police, through the 24*7 control room helpline, in case any person is found violating law and order.

"354 miscreants have been arrested across the state as a part of our endeavour to maintain peace and harmony in Bengal. In case you find anyone or anything violating the law, contact us on the WB Police 24*7 control room helpline," the tweet from West Bengal Police's official handle read.

23:06   BJP lodges police complaint against Deputy CM Sisodia, AAP MLA Amanatullah Khan
The BJP on Monday lodged a police complaint against Deputy Chief Minister Manish Sisodia, AAP MLA Amanatullah Khan and others alleging their involvement in yesterday's violence at Jamia Millia University.

In a letter to Commissioner of Police Amulya Patnaik, Delhi BJP chief Manoj Tiwari said: "This is to complain against Manish Sisodia, Amanatullah Khan and Chairman Waqf Board Delhi and other AAP leaders for hatching a criminal conspiracy, inciting violence and conducting riots at Jamia Millia Islamia on December 15."

"The incident that happened yesterday was less a protest of students and more a politically orchestrated pre-planned riot done at the behest of Amanatullah Khan, MLA and AAP leader. As is revealed in various videos being circulated in the social media and tweets, Khan was seen inciting violence immediately before the riot," the letter said.

"Similarly, Sisodia was tweeting and retweeting contents which were provocative in nature," Tiwari said.

The BJP MP further said, "On the name of students, political opportunists like Manish Sisodia, Amanatullah Khan and other AAP leaders hatched a political conspiracy to attack the police officials, burn buses and break the houses of the general public in New Friends colony."

"It needs to be thoroughly investigated which groups and organisations were behind the riots and investigation needs to be done and culprits should be arrested," he added.

22:34   Yet to see justice: Nirbhaya's parents
Parents of the December 16 gangrape victim on Monday said they have been fighting for seven years but are yet to see the culprits punished and get justice for their daughter who died in 2012 after being brutally gangraped.

"We are waiting for justice to our beloved daughter for years. Unfortunately, we could not ensure that till date. But we will not give up. Our fight would continue through Nirbhaya Jyoti Trust which has been founded to stop violence against women. The crime against women in India is on the rise and very regrettable too. The system should work to make the country safe and secure for women," said Asha Devi, mother of "Nirbhaya".

She was addressing an event here to mark the seventh anniversary of the fateful night which sparked the debate around security of women.

"Public support to our demand to hang the culprits of our daughter has encouraged us to move ahead. It is very unfortunate that even after seven years of the incident we could not ensure capital punishment for the culprits. We are desperately waiting for the execution. Thanks for your continued support," her father Badrinath Singh said.

Nirbhaya was gang-raped on the intervening night of December 16-17, 2012, inside a running bus in south Delhi by six people and severely assaulted before being thrown out on the road. She succumbed to injuries on December 29 at Mount Elizabeth Hospital in Singapore.

The four convicts in the gang rape-and-murder case have been sentenced to death.

Ram Singh, one of convicts, allegedly killed himself in 2013, while a juvenile, who was among the six accused, was convicted by a juvenile justice board. He was released from a reformation home after serving a three-year term.

"The agitation, erupted after the 2012 incident, has become a mass movement now. I express my gratitude to her parents who gave voice to the women's plight. You have advocated justice for your daughter which has now become the voice of the nation," said Deputy Chief Minister Manish Sisodia.

21:21   Jairam Ramesh challenges Citizenship act in SC
Senior Congress leader Jairam Ramesh has challenged the Citizenship Amendment Act in the Supreme Court and his plea will be heard on Wednesday.

Ramesh has challenged the new law in his personal capacity. He had filed the petition on December 13.
"Given the urgent situation that has developed around the rushed and insidious Citizenship Amendment Act, I approached the Hon'ble Supreme Court to hear my matter urgently.

"The Hon'ble judges have agreed to list my challenge to the same on Wednesday i.e. day after tomorrow," Ramesh said on Twitter.

In his petition, Ramesh has prayed that the court pass appropriate order declaring and quashing the Citizenship (Amendment) Act as "unconstitutional, null and void and ultra vires Articles 14 and 21 of the Constitution of India and hence void ab initio".

He also demanded that the court passes appropriate direction declaring that the Citizenship (Amendment) Act ultra vires the Assam Accord of 1985 and the Constitution of India.

Ramesh also sought orders declaring that that the act violates the international law and obligation approved and agreed by India under international covenants.

He said he is constrained to move the instant public interest litigation under Article 32 of the Constitution challenging the patently unconstitutional amendment to the Citizenship Act, 1955 being the Citizenship (Amendment) Act of 2019.

"The impugned Act is a brazen attack on the core fundamental rights envisaged under the Constitution. The impugned enactment ex facie violates the fundamental guarantees under Article 14 as also Article 21 of the Constitution.
"The Act has been enacted disregarding the report of the Joint Parliamentary Committee of January 7, 2019 as also the terms of the Accord between AASU, AAGSP and the Central Government on the Foreign National Issue signed on 15.08.1985 (Assam Accord)," he said.

20:48   Pranab for raising Lok Sabha strength to 1000
Former President Pranab Mukherjee on Monday pitched for raising the number of Lok Sabha constituencies to 1,000 from the existing 543 and for a corresponding increase in Rajya Sabha's strength, arguing that India has a "disproportionately large size" of electorate for elected representatives.

Delivering the second Atal Vihari Vajpayee memorial lecture organised by India Foundation here, he said the last time the strength of Lok Sabha was revised was in 1977 which, he noted, was based on the 1971 census that put the total population at 55 crore.
The population since then has more than doubled, and there is a "strong case" to remove the freeze in the delimitation exercise. It should be ideally increased to 1,000, he added.

On the occasion, he also hailed Vajpayee as a consensus-builder who worked to take everyone along and noted that people may have given strong majorities to different parties since 1952 but over 50 per cent of them have never voted for one party.
"A numerical majority in elections gives you the right to make a stable government. The lack of popular majority forbids you from a majoritarian government. That is the message and essence of our parliamentary democracy," he said.

19:07   5.42 L will benefit by Citizenship Act: Sarma
Assam Finance Minister Himanta Biswa Sarma on Monday said a maximum of 5.42 lakh people will be benefitted in the state by the amended Citizenship Act in the state.

Sarma, a senior BJP leader, said, that rumours were being spread by a certain section of people who claimed that over a crore of people will be benefitted by the act and more people from Bangladesh will pour into Assam.

He said that members of Congress and Krishak Mukti Sangram Samiti, a peasant organisation of the state, were found to be involved in the violence that rocked the state and Guwahati, its epicentre, after the amendment was passed by Parliament.

"However, we do not know at this moment if they indulged in violence in their personal capacities or at their organisational levels. A detailed probe will ascertain that, he said.

"As per the Assam government estimates a maximum of 5.42 lakh will be benefitted from the Act. It may be less than
that," Sarma told a press conference.

Asked about the source of the figure, he said that it has been arrived at after assessing persons whose names did not figure in the final list of National Register of Citizens.

18:41   Amnesty slams police action against Jamia, AMU students
The Amnesty International India on Monday slammed the police for its "violent" action against students at Jamia Millia Islamia in Delhi and Aligarh Muslim University protesting against the amended citizenship act.

It said the allegations that the police brutally beat up and sexually harassed Jamia students must be investigated and those responsible prosecuted.
The human rights body's executive director, Avinash Kumar, in a statement said the arrest of protesters violate India's obligations under international law, specifically the International Covenant on Civil and Political Rights, to respect and protect the right to freedom of expression and peaceful assembly, set out in Article 19 and Article 21 of that treaty.
"Students have the right to protest. Violence against them cannot under any circumstance be justified," he said, referring to media reports on police baton charge against the protesting AMU students.

18:22   Unnao rape: CBI pulled up for critical lapses
A Delhi court pulled up CBI on Monday for delay in filing the charge sheet in Unnao rape case as also the absence of women officers during the probe without bothering about "harassment, anguish and re-victimisation that occur for a victim of sexual assault".

It also expressed displeasure over the agency leaking selectively vital information relating to the statement of the survivor to put a cloud over her case.

"According to law there should be female officers in CBI to record statement of victims in such cases but surprisingly the girl was called many times to CBI office instead of going to her residence," the court said.

Investigation in such cases has to be conducted by a woman officer as mandated under Section 24 of the Protection of Children from Sexual Offences (POCSO) Act, but the successive statements of the victim girl had been recorded by calling her to the CBI office "without bothering for the kind of harassment, anguish and re-victimisation that occurs for a victim of sexual assault in such case", it noted.

District Judge Dharmesh Sharma said CBI has not explained the fact that when almost entire investigation had been completed by the end of July 2018, what prevented the CBI from filing the charge sheet on October 3, 2019. The judge also expressed displeasure that vital information concerning witnesses' statement was selectively leaked as an attempt to put a cloud over the case of the survivor.

He said: "When the investigation in the alleged kidnapping, illegal confinement and gang rape of the victim girl had been taken over by them (CBI) on April 13, 2018 and it is also clear from the police report that almost entire investigation had been completed by the end of July 2018, what prevented the CBI from filing the charge sheet without any further delay and it was belatedly on October 3, 2019 after almost a year.

"And I also find from the spate of applications moved on behalf of the accused person that vital information concerning statements or version of witnesses and appears to have been selectively leaked thereby attempting to put a cloud over the case of the complainant, coupled with non examination of the huge data retrieved from the two mobile phones." -- PTI

18:04   CAA, NRC in Bengal over my dead body: Mamata
Daring the Centre to dismiss her government, Chief Minister Mamata Banerjee vowed on Monday to not implement the citizenship law and the proposed NRC, which she said can only be enforced in West Bengal over her dead body.

Banerjee, who led a mega rally in the heart of the city, alleged that a few people were paid by the BJP to perpetrate violence in the state, even as she blamed some powers from outside West Bengal "acting as friends" of the Muslim community for vandalism and arson. The TMC supremo, who led the rally from Red Road to Jorasanko Thakur Bari, the ancestral house of Nobel laureate Rabindranath Tagore in north Kolkata, was joined by thousands of supporters with placards like "No CAA" and "No NRC"

"There are some forces from outside the state, who are acting as friends of minorities and have indulged in this violence. These forces are stooges of the BJP, don't fall into their trap," Banerjee said in an apparent reference to Asaduddin Owaisi's AIMIM with whom she got into a war of words recently.

"As long as I am alive, I will never implement the citizenship law or NRC in the state. You can very well dismiss my government or put me behind bars but I will never implement this black law. We will continue to protest democratically till this law is scrapped. If they want to implement it in Bengal they will have to do it over my dead body," she said.

"If the BJP thinks it can "bulldoze" everybody to implement the law, then they are wrong, she asserted. "No one will be ousted from the state. We believe in coexistence of all religions, caste and creed," Banerjee said as she read out an 'oath' for her party workers at the beginning of the rally near a statue of BR Ambedkar in Red Road. -- PTI

16:50   Plea moved in HC against police action on Jamia students
A PIL was moved in the Delhi High Court on Monday against the police action on students protesting against the amended Citizenship Act at the Jamia Millia Islamia University.

The petition was mentioned before a bench of Chief Justice D N Patel and Justice C Hari Shankar seeking that it be listed for hearing during the day. The bench, however, declined to list it on Monday, saying "there is no urgency".

The plea moved by Rizwan, a lawyer and also a resident of Jamia Nagar close to the varsity, has claimed in his plea that on December 15 while students and members of the teachers' association of the university were observing a peaceful protest, the police broke into the campus, used tear gas and also lathi-charged the protestors.

The petition, filed through advocates Tariq Khan and Apoorv Singhal, has also alleged that the police officers switched-off the lights of the reading hall, locked the doors from outside, and threw tear gas bombs inside.

Apart from that, the police fired at students and also illegally detained several of them, the plea has further alleged and sought a judicial inquiry into the incident. Rizwan, in his plea, has contended that what the police has done cannot by any stretch of the imagination be termed as justifiable police action. "It can only be called a blatant abuse of power upon unarmed and innocent students," the petition has said. Apart from the judicial inquiry, the plea has also sought proper medical treatment and compensation for the students injured in the incident.

14:32   Violent protests on Citizenship Act unfortunate: PM
As unrest over the police crackdown in Delhi's Jamia Millia Islamia rippled through the country, Prime Minister Narendra Modi said that violent protests are unfortunate and asked for peace.

"Violent protests on the Citizenship Amendment Act are unfortunate and deeply distressing. Debate, discussion and dissent are essential parts of democracy but, never has damage to public property and disturbance of normal life been a part of our ethos," Modi said in a series of tweets.

Calling the Citizenship Amendment Act as an act of acceptance and harmony he said, "The Citizenship Amendment Act, 2019 was passed by both Houses of Parliament with overwhelming support. Large number of political parties and MPs supported its passage. This Act illustrates India's centuries old culture of acceptance, harmony, compassion and brotherhood."

Modi also assured countrymen that the act will not affect any citizen of India of any religion.

"I want to unequivocally assure my fellow Indians that CAA does not affect any citizen of India of any religion. No Indian has anything to worry regarding this Act. This Act is only for those who have faced years of persecution outside and have no other place to go except India," Modi said.

"The need of the hour is for all of us to work together for the development of India and the empowerment of every Indian, especially the poor, downtrodden and marginalised. We cannot allow vested interest groups to divide us and create disturbance," he added.

12:44   7 years since Delhi gang-rape; parents seek time-bound justice
It has been seven years to that terrible day when their daughter - who came to be known as 'Nirbhaya' - was brutally gangraped and thrown off a bus. Her parents still await justice.

The tag of rape capital became all the more pronounced after the Nirbhaya incident but her parents say it is a pan-India problem and cannot bring themselves to hate the national capital, which snatched their child.

"Delhi snatched everything away. But we cannot hate Delhi since our state Uttar Pradesh has also been seeing such incidents. There is no place in the world where we can go where such incidents do not happen. You cannot hate the entire world," says Nirbhaya's mother.

But they hope and pray that things improve for the better.  In the last few days, they have seen a bit of hope, with reports saying the four accused in the case might be hanged soon.  As Nirbhaya's mother puts it, "We are hopeful. We have been waiting for it. It is not easy till the time we get their death warrant and the date."

The 23-year-old paramedic student's parents have not lost faith in God, despite facing so much.  "I have believed in karma for the last seven years. I have the support of God. But I didn't lose faith in him. Of course there are questions like 'Why did we have to face this? '" Her father says they believe in doing good karma.  While they might be closer to getting justice, they said their fight for other 'Nirbhayas' will continue.

"With the hanging of the four accused, Nirbhaya will get justice. But there are many Nirbhayas in the country.  We will fight for other daughters too," says her father.  The last seven years have given the couple a lot of experience and they now understand the loopholes of the criminal justice system and how to tackle them.  He said their fight ahead will centre around time-bound justice.

"There is no time-bound procedure for filing mercy or review petitions. There should be a fixed duration of cases," he says.  He says it is understandable that trial courts take time because they have to hear both parties and examine evidence, but high courts and Supreme Court should not take time since they only have to examine the judgement of the lower court.  "It should not go on for long and should be made online. Cases in HC and SC should not go on for more than a fortnight," he adds.  -- PTI
