UPDATE: HC sets aside Mamata govt's restrictions on Durga idol immersion

The Calcutta high court set aside on Thursday the West Bengal government's controversial restrictions on Durga Puja idol immersion, a day after it rapped Chief Minister Mamata Banerjee for creating communal divisions.

The court asked the administration to ensure separate routes for immersion and Muharram processions.

The state government had banned any idol immersion after 10 pm on September 30, the last day of the five-day festival, and on October 1 on account of Muharam. 

Banerjee had said the restrictions were necessary to maintain law and order at a time when tens of thousands of people are usually out on the streets.

On Wednesday, the court had said that the state could not hinder a citizen's right to practise religion on the basis of a mere assumption of law and order disruption and must provide sound reasons for doing so. "Let them (Hindus and Muslims) live in harmony, do not create a line between them," acting chief justice Rakesh Tiwary had said.
