Bhat has been in preventive custody under the Public Safety Act since April 2015.

Justice Muzaffar Hussain Attar, while allowing Bhat's plea challenging the latest of the detention orders under Public Safety Act, held his detention illegal on several grounds.

"By issuance of writ of certiorari, order of detention bearing No. 85/DMB/PSA/2016 dated 1.9.2016, passed by the (deputy commissioner Baramulla) is quashed with a further direction to the (government) to release Alam forthwith from preventive custody," the court had said in its order.

According to the order, Bhat was accused of making the ongoing agitation "successful" while in custody of the state authorities. The order was passed on the basis of Bhat's meeting on August 11 this year with four persons who visited him at District Jail, Baramulla.
