Let Delhi HC hear AAP vs Centre case, rules SC

Fight your battles, we will not step in, the Supreme Court seems to say.

The apex court has refused to step into the power battle between the Centre and the Aam Aadmi Party government in Delhi and said today that the High Court has to decide on the home ministry notification that limits the powers of Chief Minister Arvind Kejriwal

The SC asked the Delhi HC to hear the Delhi government's fresh plea for quashing notifications without getting influenced by any observation. "The HC must hear the case independently," the court observed.


The High Court had, earlier this week, called the notification 'suspect' and said the Lieutenant Governor, who represents the Centre, is "bound to act upon the aid and advice" of the Delhi council of Ministers.

In a two-day "emergency session" of the Delhi assembly, which ended yesterday, the AAP-dominated house called the Centre's notification 'illegal'and approached the SC over the issue.
