Dec 16 gang rape: Juvenile convict to walk free, says HC

The Delhi High Court hearing the plea of BJP leader Subramanian Swamy plea that the juvenile convict in the December 16, 2012, rape should not be released says that the juvenile (who is now 20-years old) will WALK FREE. The HC refuses to stay the release of the juvenile, which means he will walk free on Sunday.

The convict has spent the last two-and-a-half years inside a remand home as per the provisions in the Juvenile Justice Act.

Terming the juvenile convicted in the December 2012 Nirbhaya gang-rape case as an 'animal', BJP leader Subramanian Swamy last week said it is dangerous to free such a convict and appealed to the courts to make certain provisions in the law to deal with such serious offences.

"The juvenile convict should be kept with wild animals for committing such heinous crime. It is dangerous to free such people. There are certain flaws in our law. The juvenile laws are applicable only for people committing crimes like stealing food or bicycle but this law is not applicable for such kind of heinous crimes. There is no provision in the law that if such juvenile accuse do not change in the three years, then what action needs to be taken," Swamy said.

"According to the report of Indian Intelligence bureau, the juvenile accuse has turned into a jihadi. So, the court should interfere and make certain provisions in the law regarding this. The government should move court and seek to arrest the juvenile accused under National Security Act," he added.

The victim's parents reiterated that the juvenile should remain in custody.  "If someone like him gets released, it clearly shows the helplessness of the government and the law of our country. We hope that the high court takes the decision in favour of the society because even the High Court knows the suffering of my daughter," her mother said.


"I have been reiterating that the juvenile shouldn't be released, he is not committed a fault, he has committed a crime," she added.

Meanwhile, father of the victim also hoped that High Court would not release the juvenile.

"What we feel is that he should not be released, it won't be good if he gets released. But whatever the decision of High Court be it would be for the betterment of society," he said.

"The HC also knows that that juveniles like him are involved in rapes of minor girls," he added.
