Defence: Capital punishment a violation of fundamental rights

The arguments continue at the Saket fast-track court. The defence says that capital punishment is a violation of fundamental rights. That the crime occurred at the spur of the moment and was not premeditated. The lawyers argue that the 'rarest of rare' instance for pushing for the death penalty must pertain to the criminal and not the crime.
