Rebecca John, the Talwars's lawyer says what astonishes her is that an agency (the CBI) which filed a closure report saying there was no evidence in the case, has now asked for the death penalty. "It is a grotesque misuse of power, the death sentence is an irresponsible demand and the case has never merited a rarest of rare instance," she said.

The court said they found no merit in CBI's argument that the case fell under rarest of rare.
