Prerogative of legislature to decide the law: Kapil Sibal

For now, the Supreme Court has thrown the ball back at the Parliament. Union Law minister Kapil Sibal said that it is for the SC to decide constitutionally, but it is the prerogative of the legislature (the Parliament) to decide the law. But he refused to say whether the SC was right in overturning the Delhi HC verdict, thereby criminalising gay sex.

The SC said that it is for the legislature to look into the desirability of deleting the provision from the law.
