CJI Dipak Misra also said that mere adultery can't be a crime, unless it attracts the scope of Section 306 (abetment to suicide) of the IPC.

Justice Chandrachud also concurring with the other three judges.

To bring you up to speed, the five-judge bench wrote four separate judgments. CJI Misra wrote on behalf of himself and Justice Khanwilkar. Justices Nariman, Chandrachud and Malhotra wrote a judgment each.
